Sometimes a proprietor's appointee resigns or can no longer be on the board for another reason.
This is when a "vacancy" occurs.
There is another way to create a vacancy for a proprietor's appointee. We'll discuss all the possible ways in the next section.
While it's the proprietor's responsibility to fill the position, there are some things your board needs to do.
How can a vacancy happen?
A vacancy occurs when an appointed board member:
- Dies or is incapacitated
- Resigns in writing to the proprietor
- Is no longer eligible to be a board memberopen_in_new for a financial or other reason
- Misses three board meetings in a row without the board approving "prior leave".
A vacancy can also occur if the proprietor increases the number of proprietor appointee positions on the board by altering its constitution.
Does the proprietor have to fill the vacancy?
When a vacancy occurs, the proprietor will need to find someone to fill the position.
How they select them and when they do so is up to them, but this is normally done as soon as practicable.
What does your board need to do?
Once the proprietor has advised the details of the new appointee (or whether the position will be left vacant), you need to:
- Record the details in your board meeting minutes
- Update your board member registeropen_in_new and complete the School Board Updatesopen_in_new form
- Advise your school community of the changes.

- Have we recorded the changes in our board meeting minutes?
- Have we updated our board member registeropen_in_new and completed the School Board Updatesopen_in_new form?
- Have we advised our school community of the change?
- If the position will be left vacant, has the proprietor altered our board's constitution?
